1. Who we are

FarmEquipment Rentals ("we", "us", "our") is a Canadian company established in 2017, located at 133 Clearview Drive, Reinfeld, Manitoba R6W 4A1, Canada. We provide sales, rentals, and service of construction and agricultural equipment across Western Canada, including through this website, farmequipmentrentals.online (the "Site").

By creating an account, making a reservation, or otherwise using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

2. Accounts

• You must be the age of majority in your province (18 or 19) to create an account and rent equipment.
• You agree to provide accurate information and keep your login details secure. You are responsible for activity under your account.
• We may suspend or close accounts that violate these Terms or that we reasonably believe are fraudulent.

3. Reservations, confirmation & payment

• Submitting a reservation on the Site creates a request with the status "Pending". A reservation is not final until we review it and mark it "Confirmed", at which point we will contact you about payment and delivery.
• Prices are shown per day, and where available per week or per month. The total shown at reservation is calculated from your selected dates and plan. Applicable taxes, delivery charges, or deposits may be added and will be communicated before confirmation.
• Payment is made according to the payment instructions we provide. After paying, you must email your payment confirmation to farmequipmentrentalssupport@gmail.com. Your booking is finalized once payment is verified.
• Listed availability is indicative. If equipment becomes unavailable for your dates, we will offer alternative dates, alternative equipment, or a full refund of any amount paid.

4. Cancellations & refunds

• Pending requests can be cancelled by you at any time, free of charge, from your dashboard.
• Confirmed bookings: contact us as early as possible at farmequipmentrentalssupport@gmail.com. Cancellations made before the equipment is dispatched are refunded in full, minus any costs already reasonably incurred. Once equipment has been dispatched or delivered, rental charges for the agreed period may apply.
• If we cancel a confirmed booking for any reason other than your breach of these Terms, you receive a full refund of amounts paid.

5. Rental terms & use of equipment

• Equipment is inspected before delivery and provided in good working order. Please inspect it on arrival and report any issue immediately.
• You agree to use equipment only for its intended purpose, following the manufacturer's instructions and all applicable laws and safety regulations, and to ensure it is operated only by competent persons.
• Equipment remains our property at all times during a rental. You may not sell, lend, sub-rent, modify, or take the equipment outside the agreed service area without our written consent.
• Equipment must be returned (or made ready for pickup) at the end of the rental period in the condition received, normal wear and tear excepted, and reasonably clean.
• Late returns may be charged at the applicable daily rate for each additional day.

6. Damage, loss & breakdowns

• You are responsible for loss, theft, or damage to the equipment beyond normal wear and tear that occurs during your rental period, up to the repair or replacement value.
• Report any breakdown, damage, or malfunction to us immediately at farmequipmentrentalssupport@gmail.com and stop using the equipment if continued use could worsen the issue or be unsafe.
• If a genuine equipment fault (not caused by misuse) prevents your work, we will repair, replace, or fairly adjust the rental charges.
• Do not attempt repairs yourself without our approval.

7. Delivery & pickup

Delivery and pickup are arranged when we confirm your reservation. You agree to provide safe, lawful access to the delivery location and to have someone available to receive the equipment. Delivery timing is coordinated with you and may be affected by weather and road conditions.

8. Acceptable use of the Site

• Do not misuse the Site: no unauthorized access attempts, scraping, interference with other users, or fraudulent reservations.
• We may remove content or restrict access to protect the Site and its users.

9. Liability

To the maximum extent permitted by law: the Site is provided "as is"; we are not liable for indirect or consequential losses (such as lost profits or crop losses) arising from equipment use or Site use; and our total liability for any claim is limited to the amounts you paid for the rental in question. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including under Manitoba consumer protection legislation.

10. Intellectual property

The Site's content, branding, and design belong to us or our licensors and may not be copied or reused without permission.

11. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the current version. Continued use of the Site after changes means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada applicable in it. Disputes are subject to the courts of Manitoba.
